Terms and Conditions
By entering the 'Spreets – Bali Giveaway" Competition (the "Competition"), you are agreeing to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.
2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open to all residents of Australia who are 18 years of age or older.
2.2 Directors, management, employees and their immediate families of Spreets Pty Limited (the “Promoter”) or Escapes.com.au Pty Ltd (“Sponsor”), Mnet Mobile Pty Ltd and their associated agencies and companies are not eligible to enter.
3. HOW TO ENTER
3.1 The Competition commences on Tuesday, 1 July 2014 at 10.00 a.m. (A.E.S.T) and concludes on Monday, 1 September 2014 at 5:00 p.m. (A.E.S.T) (the “Competition Period”).
3.2 In order to enter, the entrant must:
(a) Go to the Spreets Bali Family Holiday Giveaway landing page located at http://spreets.jackmedia.com.au/landing/index/Spreets-Bali-Family-Holiday-Getaway; and
(b) Enter their first name and last name, their email address, gender, date of birth and postcode
(c) Agree to subscribe to Spreets entry database to receive emails from Spreets and remain subscribed until the prize draw on Friday 5 September 2014 at 11:00 a.m. AEST.
3.3 Subject to clause 3.4, entrants may enter the Competition once during the Competition Period.
3.4 Following submission of the Competition entry form, Entrants will be presented with a page that will enable them to do any or all of the following:-
(a) Entrants may refer a friend to the Competition by providing their friends’ email addresses in the Competition entry form, provided they have the express consent of each friend to do so. Entrants will automatically be entered into the Competition one additional time each for each friend they refer, up to a maximum of 10 additional entries.
(b) Entrants may click on the ‘Like’ button and share the Competition on Facebook. If an entrant does this, they will automatically be entered into the Competition one (1) additional time
(c) Entrants may click on the ‘Tweet’ button and Tweet the Competition to their followers on Twitter. If an entrant does this, they will automatically be entered into the Competition one (1) additional time
3.5 Following submission of the Competition entry form, Entrants will be presented with a page that will enable them to opt in to other advertisers’ newsletters. If the entrant agrees to opt in then the promoter will transfer their details to the advertisers that the entrant has opted in to only.
3.6 The time of entry will be the time at which the entry is received by the Promoter. Entries received outside of the Competition Period will be deemed invalid and ineligible to enter the Competition.
3.7 The Promoter reserves the right in its sole discretion to reject bulk entries which it considers to have been generated using software to generate multiple entries.
4. PRIZES
4.1 One (1) winner (“Winner”) will be drawn in respect of the Competition Period and will receive the prize as detailed in Clause 4.2.
4.2 The prize (the “Prize”) consists of:

Total Prize pool value is A MAXIMUM OF $5,399.00. Prize values are based upon the average retail price of this kind of prize. The Promoter accepts no responsibility for any change in Prize value between now and the end of the Competition Period.
4.3 Flights lleave from the Winner’s nearest capital city. The Winner and their travelling companions must travel on the same flight. Travel arrangements to and from the Winner’s residence and nearest capital city airport (Sydney, Melbourne, Brisbane, Adelaide, Perth and Darwin) do not form part of the prize and are the responsibility of the Winner. If the Winner is from ACT or TAS then they will be required to travel to their nearest capital city airport that is specified above. This travel will be at the Winner’s own expense.
4.4 The Prize detailed in clause 4.2 must be fulfilled before Monday, 25th May 2015. The Winner must provide at least thirty (30) days prior notice to the Sponsor of their intended travel dates. Flights and accommodation are subject to availability at the time of booking, are non-transferable and cannot be exchanged for other destinations. Embargo restrictions apply during certain periods including, without limitation, that the Prize is not redeemable between Friday, 26 December 2014 and Tuesday, 6 January 2015.
4.5 The Winner and their travelling companions must be able to travel on the days specified in clause 4.4.
4.6 The Winner and their travelling companions must each hold a valid passport with at least 6 months validity in order to redeem the Prize. Obtaining all travel documents such as passports, visas etc that are required for travel to destinations in the Prize is the responsibility of the Winner and their travelling companions.
4.7 The Winner agrees they will not, and will ensure that their travel companion does not, sell or otherwise provide their story and/or photographs to any media or other organisation.
4.8 Prizes are not transferable and cannot be redeemed for cash. The Winner should seek independent financial advice about any tax implications that may arise from the Prize winnings.
4.9 The accommodation type offered for each Prize is specified in clause 4.2 and must be taken in consecutive nights’ stay.
4.10 In participating in the Prize, the Winner (and their travelling companions) agrees to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The Winner (and their travelling companions) agrees to grant the Promoter a perpetual and non-exclusive licence (including the right to sub-licence) to use their names and such footage and photographs in all media worldwide and the Winner (and their travelling companions) will not be entitled to any fee for such use.
4.11 In the event that a part of the Prize is no longer available, subject to state government legislation regulations, the Promoter reserves the right to substitute prizes in its discretion to the same and equal recommended retail value.
4.12 Unless expressly stated in these Terms and Conditions, all other expenses associated with redeeming the Prize become the responsibility of the Winner. The Winner (and their companions) are responsible for all expenses other than that specified, including but not limited to flights, spending money, transfers, meals, drinks, incidentals, mini-bar, laundry, room service, telephone calls, activities, insurance, energy surcharges, gratuities, services charges, travel insurance, excess baggage and all other ancillary costs. Travel insurance is the responsibility of the Winner and their companions. The Promoter and the Sponsor are not liable for any costs incurred if the Winner or their companions travel without insurance.
4.13 The Sponsor is solely responsible for the fulfilment of the Prize.
5. HOW TO WIN
Each entrant who enters the Competition during the Competition Period in accordance with these Terms and Conditions will be entered into the random draw. The first entrant randomly drawn from the pool of entrants will be the Winner.
5.2 The draw will be conducted on Friday, 5 September 2014 at 11:00 a.m. AEST by MNet Mobile Pty Limited, L1, 16 Anster Street, Adelaide SA 5000.
5.3 The Winner will be notified of their Prize by an email sent within two (2) days of the draw referred to in clause 5.2. The notification will be sent to the email address registered in the entry.
5.4 The Winner’s details will be published on the Spreets website located at http://spreets.jackmedia.com.au/landing/index/Spreets-Bali-Family-Holiday-Getaway at 2:00 p.m. AEST on Tuesday, 9 September 2014.
5.5 The Promoter reserves the right to request that the Winner provide proof of age and/or identity prior to awarding the Prize. Identification considered suitable for the verification is at the sole discretion of the Promoter.
5.6 The Promoter’s decision (including any decisions as to prize distribution) is final and the Promoter will not enter into correspondence regarding the result.
5.7 It is a condition of accepting a Prize that the Winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
5.8 Subject to regulations, if Prizes remain unclaimed for more than three (3) months after the first draw date as stated in clause 5.2, an unclaimed prize draw will be conducted by MNet Mobile Pty Limited at L1, 16 Anster Street, Adelaide SA 5000 on Friday, 5 December at 11:00 am AEST and the Winner’s details will be published on the Spreets website located at http://spreets.jackmedia.com.au/landing/index/Spreets-Bali-Family-Holiday-Getaway at 2:00 p.m. AEST on Tuesday, 8 December 2014
5.9 It is a condition of accepting a Prize that the Winner must comply with all the conditions of use of the Prize and the Prize supplier’s requirements. To the extent of any inconsistency with these Terms and Conditions, the terms and conditions of the Prize supplier prevail.
6. NO LIABILITY
6.1 Any costs associated with entering this promotion or claiming Prizes (such as internet service charges) are the responsibility of the entrant.
6.2 Subject to any restrictions in law and subject to clause 6.4, the liability of the Promoter however arising, whether by breach of any condition or warranty implied by statute or of this agreement or of any duty of tort (including negligence) is limited to the total value of the relevant Prize.
6.3 The Promoter, the Sponsor and their associated agencies and companies will take no responsibility for Prizes damaged or lost in transit, or late, lost or misdirected mail.
6.4 The Promoter, the Sponsor and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim suffered or brought by an entrant or their companion:
a) at the drawing of the Competition;
b) in their participation in this Competition or in any Prize;
c) whilst undertaking any travel won or connected with their entry into the Competition;
d) as a consequence of late, lost or misdirected mail;
e) as a result of failure to comply with any of these terms and conditions; or
f) due to the publication of any material, including any statements made by any staff member, journalist, other entrants or any other person.
6.5 The Promoter, the Sponsor and their affiliates accept no responsibility for any problems or technical malfunction of any communication network or for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft or destruction or unauthorised access to, or alteration of, entries, and reserves the right to take any action that may be available.
6.6 If, for any reason, this Competition is not capable of being conducted as planned, including, but not limited, due to tampering, unauthorised intervention, fraud, technical failures or for any other reason which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available or to cancel, terminate, modify or suspend the Competition, subject to state legislation.
6.7 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions.

7.2 The Sponsor is Escapes.com.au Pty Ltd of 1A Building, 21 Banksia Drive, Bryon Bay NSW 2481 (ACN 149 240 433)..
7.3 PERSONAL INFORMATION COLLECTION NOTICE: By entering this Competition, you agree to the Promoter collecting, using and disclosing your personal information for the purpose of conducting and promoting this Competition, in accordance with Spreets’ Privacy Policy which is available at http://spreets.com.au/page/privacy-policy which you acknowledge you have read and agree to. This privacy policy contains important information regarding how the Promoter handles your personal information, including how you can access and/or correct your personal information, make a complaint about the handling of your personal information and the manner in which the Promoter may disclose personal information overseas. Additionally, by ticking the relevant opt in box/es, (a) you agree to the Promoter and its trusted partners using your personal information to help the Promoter communicate with you (including via electronic messages and/or telephone) about offers from the Promoter and its marketing partners (which offers you may opt-out of receiving), and you agree to the Promoter disclosing your information to such partners in connection with such purposes and/or (b) you agree to the Promoter sharing your personal information with the Sponsor and you acknowledge that the Sponsor will be solely responsible for its use of such information. Entry into the Competition is conditional upon providing your personal information. If you do not provide your personal information when requested, you may not enter the Competition.
7.4 By entering this Competition, all entries become the property of the Promoter and your name will be included on the Spreets database and if you consent, the Promoter will include your name in future mail, email, SMS or other campaigns.
